What the Law Says About ‘Being in Charge’

Under UK law, an individual may be found “drunk in charge of a vehicle” even if they are not driving or have not moved the vehicle. This can apply in several situations, such as:

  • Sitting inside a vehicle with the keys in the ignition

  • Standing near a vehicle while holding the keys

  • Being close to the vehicle with the apparent intention to drive later

Law enforcement officers may interpret these circumstances as evidence of intent to drive while over the legal alcohol limit. Depending on the situation — and the individual’s level of intoxication — a person may face warnings or formal prosecution.

Advice on Staying Safe and Compliant

While legal consequences vary based on the facts of each case, experts advise that individuals avoid going near their vehicle after consuming alcohol. Even being in possession of car keys can be enough to attract suspicion or lead to charges.
