A pair of late-night motorcyclists have appeared in court after they were both found to be exactly the same amount over the drink driving limit.
Police were suspicious when they saw the two 20-year-old men on their bikes just before midnight on June 17. Niamh Reading, prosecuting, said the two men were stationary at a junction on the A19. “They were side-by-side. The officers made an attempt to speak with the males but, by the time they had turned around their vehicles, they were travelling away.
“They activated their blue lights to indicate for the drivers to pull over. Both males did stop and complied with the officers. Both presented as though they had consumed alcohol and were requested to do roadside breath tests.”
After testing positive for alcohol, further analysis found each to have 50mcg alcohol per 100ml breath – the legal limit for drink driving is 35mcg.
Representing both defendants, Mark Harrison suggested to North Tyneside Magistrates Court that they should be treated equally, despite one of them having a previous, unrelated conviction, as they had co-operated fully with police and entered a guilty plea to drink driving at the first opportunity.
“They made a stupid error of judgement, no more than that,” he said. “There’s nothing in the manner of driving that causes police concern.”
Both men were banned from driving for twelve months and ordered to pay a fine of £120 each, plus £40 costs and a £48 victim surcharge.
