A sales advisor from York has been banned from the roads for five years after being convicted of drink driving for the third time.
Police apprehended the 33-year-old after he drove past them at speed in the Clifton area of the city on March 6, prosecutor Joanne Markham told the York Magistrates.
Representing himself, the defendant said he had simply been trying out a friend’s car. “It was a nice car,” he said, describing the 14-year-old Ford Focus. “I’d had two drinks and I didn’t think I was over the limit. I don’t drink and drive.”
The man went on to say that he hadn’t realised how strong his drinks were as they had been made for him while drinking with friends. Speaking of his attempt to get away on foot, he said simply “I panicked when I was pulled over.”
District Judge Adrian Lower pointed out the defendant’s previous convictions for drink driving from 2010 and 2014: “When is it going to sink into you drinking and then getting behind the wheel is an extremely stupid thing to do?”, he asked. “So what, if it is an attractive car? So what if you thought it was a bit of fun? You know you don’t drink and drive.”
After hearing the man plead guilty to drink driving, Judge Lower banned him from driving from five years. He also bound him with an 18-month community order with a 10-day rehabilitation activity requirement, 100 hours’ unpaid work, and imposed a £90 statutory surcharge and £85 prosecution costs.
