A soldier from the Royal Artillery has appeared in front of York magistrates on his second drink-driving charge and faces another disciplinary from his commanding officer.
Hayden John McIntee, 21, was stopped on Fishergate in York on January 21. He was found to be almost twice the legal drink-drive limit with a reading of 62mcg alcohol per 100ml breath.
Mitigating, Rachel Fletcher offered a character reference from his senior officer to the court which described him as an “exemplary” soldier who had topped a leadership course with the Army and won several awards.
She added that McIntee had travelled to York to meet with friends, and had stopped drinking early as he knew he would have to drive back to his base in Portsmouth the next day.
McIntee, from Cliffe, North Yorkshire, was on 12-hour notice to move and is expecting deployment to Germany, making curfew or unpaid work a difficult sentence to impose.
Following the court hearing, McIntee will go on to face a disciplinary meeting with his commanding officer where he is expected to receive a further fine, as well as the loss of his promotion from November and the £5,000 pay increase.
Richard Goodacre, the senior magistrate sitting with a colleague, said that even though McIntee had progressed well in his Army career, he had failed to learn the lessons from his first conviction.
McIntee pleaded guilty to the drink-driving charges and, taking the army’s response and his service, he was banned from driving for 40 months and fined £70. He was also ordered to pay £85 costs and a £37 statutory surcharge.
