A 28-year-old man has been jailed after he crashed his car into a tree at 40mph while drink and drug driving.
Police estimated that he was travelling at 40mph in a 30mph zone and overtaking two vehicles when he lost control of his Volvo V70 as he approached a left-hand bend, colliding with a tree and landing in a nearby garden.
The man’s 44-year-old rear-seat passenger was pronounced dead at the scene just before 10mp on May 29, 2019.
The front-seat passenger suffered fractures to his sternum and ribs, and a punctured lung while the driver himself suffered spinal and rib fractures. Both were treated at Southport Hospital.
Blood tests revealed that the driver was more than double the legal limit for drink driving and was more than five times the legal drug driving limit for Benzoylecgonine – a byproduct of cocaine.
The man’s drink and drug driving were treated as aggravating factors in the judges sentencing decision for causing death by dangerous driving and causing serious injury by dangerous driving.
The judge sentenced the defendant to seven years and four months for the first charge and two years and eight months for the second. The sentences are to run concurrently.
He was also banned from driving for 11 years and eight months and will have to take an extended retest.
