A 39-year-old man has lost his licence after he was caught drink driving with his son in the car and crashed into a hedge.
Prosecutor Simon Dykes told magistrates at North Staffordshire Justice Centre that the accident occurred in the early evening on October 17.
He said: “A small white vehicle collided with shrubbery. Police attended the scene. They discovered a Suzuki Swift in the middle of the carriageway and the defendant was trying to push the vehicle. It began to roll back towards the police vehicle. Officers had to stop a second collision.
“The defendant had been driving. He said something ran out in front of him causing him to swerve.”
A roadside breath test proved positive for alcohol and a later evidential sample gave a reading of 70mcg alcohol per 100ml breath, which is twice the legal drink driving limit of 35mcg.
The prosecution also advised the court that the defendant had a previous conviction for the same offence.
Mitigating, Harpreet Jhawar said his client sees his son at weekends. “A plan had been made for the pair to go out and have Sunday lunch at a pub.
“While at the pub he received a call from his mum who was distressed. He decided to get back in the car and go home to his mum. Something darted across the carriageway in front of him. He took evasive action and collided with some shrubbery. A person helped push the car back on the carriageway.”
Jhawar added that his client is a forklift truck driver at premises 14 miles from his home and losing his licence would be a “severe inconvenience”.
After pleading guilty to drink driving, magistrates imposed a fine of £315 plus £135 costs ad a £34 victim surcharge. He was also banned from driving for 40 months, although this may be reduced by 40 weeks on completion of the drink driver’s rehabilitation course.
