A woman from Maryport has received a 17-month driving disqualification after being caught operating a mobility scooter while over the legal alcohol limit.
Emma Brady, aged 29, was stopped by police in the early hours of 13 October 2025 while riding a Silver Pride electric mobility scooter on Ellenfoot Drive. Officers on patrol observed the vehicle travelling towards them and initiated a stop using their vehicle’s blue lights.
Upon speaking with the defendant, officers suspected that she was under the influence of alcohol. A roadside breath test was conducted, and Brady was later taken to the police station, where she provided a reading of 67 microgrammes of alcohol per 100 millilitres of breath. The legal limit in England is 35 microgrammes.
The court heard that a passenger was also riding on the back of the scooter at the time of the incident.
During the hearing at Workington Magistrates’ Court, defence solicitor John Cooper raised the legal ambiguity surrounding the classification of mobility scooters. He noted that certain models are excluded from being considered motor vehicles unless they are equipped with lights, indicators, and mirrors. He stated that his client was unaware she was prohibited from using the scooter while under the influence, adding that the vehicle belonged to a friend and that she had only briefly “had a go” on it.
Mr Cooper further argued that, unlike motor vehicles which can reach speeds in excess of 100mph, the mobility scooter had a maximum speed of 8mph and that the streets were empty at the time.
Brady, of Dan Wilson Avenue, Maryport, pleaded guilty to driving a motor vehicle while over the prescribed alcohol limit. In addition to the driving ban, which may be reduced by 17 weeks upon completion of a rehabilitation course, she was fined £120 and ordered to pay £85 in court costs along with a £48 victim surcharge.
