Man Caught Drink Driving On Way To Get Dinner Ingredients

A man who had a glass of wine before making dinner was caught drink driving because he realised he didn’t have the ingredients needed, Teesside Magistrates have heard.

Prosecuting, Michael Embleton told the court that police were following the man when he came to a natural stop on January 24. They approached and performed a breathalyser test on him, giving a positive reading for alcohol.

Following his arrest, he was found to have 64mcg alcohol per 100ml breath where the legal limit for drink driving is 35mcg.

Mr Embleton added that the man had no previous convictions and was of previous good character.

Mitigating, Ross Tismond said: “It is very rare that I speak to a defendant who is as apologetic and remorseful for his actions.”

“He was at home making his tea. He had consumed a glass of white wine. He realised he needed some ingredients.”

Mr Tismond added that his client drove the “very short distance” to the shop and back, and doesn’t know why police were following him as there was no suggestion of any aggravating features to his offence or problems with his driving.

The 28-year-old pleaded guilty to drink driving at the earliest opportunity, with magistrates banning him from the roads for 14 months which may be reduced by 14 weeks upon completion of the drink drivers’ rehabilitation course. He must also pay a fine of £530 plus £85 costs and a £212 victim surcharge.
