A 22-year-old care worker has been banned from driving for 44 months after admitting her second drink driving offence during which she left her car on a garage forecourt.
The court heard that police were refuelling their vehicle at the same petrol station when they noticed the abandoned car.
Prosecuting, Angela Trafford said: “A man told them a woman had driven it on the forecourt. Checks were conducted and the defendant was spoken to. She smelt of intoxicating liquor.
“She was taken to the Northern Area Custody Facility in Etruria where she gave a positive reading of 92 micrograms of alcohol in 100 millilitres of breath, against the legal limit of 35.”
The woman admitted she had drunk a bottle of prosecco after leaving her home following a row with her partner. She could not explain why she had decided to drive, but accepted that she had done so. She pulled into the garage because the tyres on her car were flat.
A roadside breath test found her to have 92mcg alcohol per 100ml breath, where the legal drink driving limit is just 35mcg.
The court also heard that the woman had a previous conviction for drink driving.
According to the probation service: “She drank at least a bottle of Prosecco. She was drinking eight or nine bottles of wine a week. She has had a problem with alcohol consumption since the age of 17. She is now alcohol-free for 16 days.”
Mitigating, Simon Leech said that his client was 19 at the time of her first conviction: “A designated driver was intoxicated and she chose to drive him and a six-year-old home.
“She has been struggling with alcohol since her late teens. There has been a sense of self-isolation.
“Matters came to a head on this day. There was an argument. She found herself leaving the house. She had not been drinking and driving. She had been at home and she chose to leave the house following the argument which led to her coming to the attention of the police.”
After pleading guilty to drink driving, magistrates ordered her to complete a rehabilitation activity requirement of 25 days and imposed a fine of £153 plus £135 costs and a £95 surcharge. Her ban may be reduced by 44 weeks on completion of the drink driver’s rehabilitation course.
