Jail For Drink Driver Breaking Lockdown

May 19, 2020

A 29-year-old man from West London has been jailed after he was caught drink driving in Brighton during the lockdown.

The court heard that the defendant, originally from Poland, had also been recently banned from driving.

Sussex police apprehended him on 24th April and found him to have 90mcg alcohol per 100ml breath – more than two-and-a-half times the legal drink driving limit of 35mcg, and upon his arrest, the man tried to claim he was someone else.

District Judge Amanda Kelly said she had no choice but to impose a custodial sentence because he had shown a “flagrant disregard for other road users”, committed the offence so soon after a driving ban, and because he then “gave false details”.

After hearing him plead guilty to drink driving, driving while disqualified, and driving without insurance, she jailed him for 8 weeks for the first offence and 8 weeks for the second, to be served concurrently.

Judge Kelly also banned him from driving for three years and 28 days, and imposed a victim surcharge of £128.
