A biker from Essex has been banned from the roads after a drink driving accident following a row with his wife.
The court heard that the 44-year-old had been drinking at a barbecue in the hours prior to his crash. On returning home he argued with his wife and went for a ride to try and diffuse the situation and calm down. He did not think he was under the influence of alcohol.
During the ride, the defendant crashed his bike, but no-one else was involved. When police arrived at the scene of the accident he was already being loaded into an ambulance.
A roadside breath test proved inconclusive, however, a later blood test showed the man to have 117mg alcohol per 100ml blood. The legal drink driving limit is 80.
Mitigating, Ralph Piggot told the court: “They had a barbecue earlier that day and later on got into a row with his wife.
“He went for a ride to cool off and felt perfectly fine to drive.
“Fortunately, the crash didn’t involve any other vehicle, pedestrian, property or street furniture – he simply came off as he was going round the corner.
After pleading guilty to drink driving, magistrates banned him from driving for 14 months, imposed a fine of £250, and ordered him to pay a £34 victim surcharge and £105 costs.
