A 52-year-old woman from Perthshire has been banned from the roads for more than four years after she was court drink driving for the second time.
Perth Sheriff Court heard that on May 15, 2022, the woman was seen swerving across the road and into the oncoming carriageway before coming to a halt in the middle of the road.
Prosecuting, Fiscal Depuite Michael Sweeney said: “A witness was driving with her young children on the B954 Newtyle to Meigle road at 7.15 pm when they saw the accused’s vehicle swerving all over the road.
“It was swerving into the oncoming carriageway and onto the grass verge. She was described as slowing down and speeding up and then she suddenly stopped in the middle of the carriageway.
“The vehicle with the young family in it was directly behind. The accused got out of her car and the witness got out and asked if she was OK.
“She could smell alcohol and took the decision to take hold of the car keys and remove them until the police arrived.
A roadside breath test gave a reading of 146mcg alcohol per 100ml breath, against the Scottish legal drink driving limit of 22mcg. An evidential sample following her arrest gave a reading of 106mcg.
The court also heard that the woman had appeared in court on a similar charge in 2019 when she was found to be nearly seven times the legal limit. She was fined £600 and banned from the roads for 16 months.
Mitigating, Pauline Cullerton said: “She takes full responsibility for this offence and does not make any attempt to justify or minimise it. She acted impulsively and is extremely ashamed and embarrassed to find herself in court.
“She is very aware of what could have happened. Thankfully nothing happened, but she is well aware that this could have been much worse than it was.”
On sentencing, Sheriff Gillian Wade told the woman: “You have issues, but the way to deal with them is not to drink copious amounts of alcohol and drive on public roads where you constituted a danger to other people.”
After pleading guilty to drink driving, the court banned her from driving for 50 months. She must also undertake 150 hours of unpaid work and was placed under social work supervision for two years.
