A 75-year-old man has appeared before magistrates in Newcastle after being caught drink driving for the second time in four years.
The court heard that police officers noticed the man as he travelled in his Peugeot, with prosecutor Claire Armstrong saying: “They saw the car swerving several times and making contact with the nearside curb. The car was stopped and the defendant was spoken to.”
After failing a roadside breath test, an evidential sample in custody found the man to have 55mcg alcohol per 100ml breath. The legal limit for drink driving is 35mcg.
Mitigating, Steve Davis said that his client had been out shopping when he received the news that someone he knew had died. He went to the British Legion Club where he drank three pints before getting in his car to go home.
“He believed he was ok to drive,” said Mr Davis. “The journey from the club to his home is less than a mile.”
On sentencing, District Judge Paul Currer told the man: “It was 5.30pm and you had a reading of 55mcg. You shouldn’t have been driving. You present a danger to yourself and others. Because of your previous conviction, I must impose the mandatory three-year driving ban.”
After pleading guilty to drink driving, in addition to the three-year ban, the man must pay a fine of £150 plus £85 costs and a £60 victim surcharge.
