Drink Driving Ban For Derbyshire Dad After Crashing Into Wall

A 41-year-old man from Derby has appeared before South Derbyshire Magistrates after a drink driving accident led him to crash into a wall.

Prosecuting, Alice Hornsby told the court that police were called to reports of a collision at around 5.30am on January 22.

Said Ms Hornsby: “The police arrived and found the van. The defendant confirmed he was the driver and that he also did not have any insurance.

“He was outside the vehicle and provided a breath test sample which gave a reading of 59.”

The legal limit for drink driving is 35mcg alcohol per 100ml breath.

Ms Hornsby continued: “In interview he made full admissions to the offence saying he bought the vehicle in Burton and drove it back to Derby.

“He said he had been to his children’s address in Stockbrook Street and while there had drank two or three bottles of Becks (lager).

“He has one relevant previous conviction from April 1, 2021, for failing to stop following an accident and driving without due care and attention.”

Representing himself in court, the man told magistrates “lessons had been learned” and that he was sorry for his offending.

After pleading guilty to drink driving and driving without insurance, magistrates banned him from the roads for 16 months and imposed a fine of £120.

The chair of the bench told him: “That is the fine for someone who is out of work.

“We wish we could fine you more to teach you a lesson because drink-driving, driving with excess alcohol or whatever you want to call it is a serious matter.

“You are a very lucky man that you did not hurt yourself and you did not hurt anyone else.

“It could have been far, far, worse.”

The man must also pay £85 costs and a £34 victim surcharge.
