Suspended Sentence For Van Driver Who Killed Cyclist

It has been reported a van driver, who knocked down and killed a cyclist, has escaped an immediate custodial sentence.

The cyclist, Sam Boulton died in hospital after injuries he suffered from the collision outside Leicester train station.

The collision was caused by a taxi passenger opening their door, causing Mr Boulton to swerve into the path of the van.

The taxi passenger, Many Chapple was fined £80 earlier this month for the offence of opening a car door, or causing, or permitting it to be opened, so as to cause injury in connection with the death of Mr Boulton.

The taxi driver, Farook Yusuf Bhikhu has pleaded not guilty to the offence and is due to stand trial on 5th June 2017.

The van driver, 50-year-old Neil Ingram pleaded guilty to failing to stop at the scene and drink driving.

The court heard that Ingram, who described himself as a “chronic alcoholic”, only left the scene of the accident owing to the shock of what had happened and not because he had been drinking and driving.

He stated he only drank after he left the scene and when he was arrested at home, found to be 3 times over the drink driving limit.

The prosecution told the court that calculations showed Ingram was over the drink driving limit at the time of the collision. Ingram admitted to drinking every day and had done so the night before driving.

Ingram was banned from driving for 18 months and received a 26-week custodial sentence, suspended for 12 months and conditional on him attending a 12-week course to tackle his alcohol addiction.
